Terms of Service
These Terms of Service ("Terms") govern your use of SpinChoice and other tools available at toolselect.co (the "Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Free Use
SpinChoice is free to use for both personal and commercial purposes. You do not need an account, and there is no payment required. We reserve the right to change this in the future, but any change will not retroactively affect wheels you have already created.
2. Acceptable Use
You agree to use the Service in good faith and in compliance with all applicable laws. You may not:
- Use the Service to harass, defame, or harm any individual or group.
- Submit content that is illegal, hateful, sexually explicit, or otherwise objectionable.
- Use automated tools or scripts to abuse the Share API or generate excessive traffic.
- Attempt to interfere with, disable, or compromise the Service or its underlying infrastructure.
- Use the Service to make decisions that have legally binding consequences without proper legal advice.
3. Shared Wheels and Content
When you create a shared wheel, you grant us a limited, non-exclusive license to store and serve that content for 90 days so that other users with the link can access it. You retain ownership of the content you create. We do not actively moderate shared wheels, but we reserve the right to remove any wheel that violates these Terms or that we receive a valid complaint about.
4. No Warranty
The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that any results obtained will be accurate or reliable.
The random results generated by the wheel are for entertainment, decision-making assistance, and casual use only. They should not be relied upon for legal, financial, medical, or other consequential decisions.
5. Limitation of Liability
To the maximum extent permitted by law, SpinChoice and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising out of your use of the Service.
If you choose to use the Service for a giveaway, contest, raffle, or other event with real-world consequences, you are responsible for ensuring the result is recorded, communicated, and honored fairly. We are not responsible for disputes between users or participants.
6. Third-Party Services
The Service uses third-party services including Cloudflare (hosting), Google Analytics (analytics), and Google AdSense (advertising). These services have their own terms and privacy policies, which you should review independently.
7. Changes to the Service
We may modify, suspend, or discontinue the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.
8. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Service after changes constitutes acceptance of the updated Terms.
9. Governing Law
These Terms are governed by the laws of the jurisdiction in which the Service operator is established, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
